If I see a felony, can I get in trouble if I do not report it to Police?

Answer:

South Dakota Codified Law § 22-11-12 provides that it is "misprison of a felony" and a Class 1 misdemeanor for any person to fail to immediately disclose to the proper authorities any knowledge a person may have regarding the commission of a felony.  Misprison of a felony carries a maximum punishment of 1 year in the county jail and/or a $1,000 fine
